Important Notice
Hamba Safe is a membership-based service. The terms below set out when membership starts, how services are activated, what information may be required, what Hamba Safe does and does not provide, and the exclusions and liability limits that apply to the service.
Membership Based
Access to Hamba Safe services depends on successful onboarding, required information, and payment of the first membership fee.
Facility Support
Hamba Safe facilitates verification, transfer and admission support to an appropriate medical facility where applicable.
Important Limits
These terms also explain exclusions, what costs are not covered, and the overall limits on liability.
1. Membership
Hamba Safe is a membership offering. Any person aged 18 years or older may apply for membership.
- The service is available once consent and personal information have been received.
- You consent that Hamba Safe may access and share information reasonably necessary to render the services, including past and future medical records, criminal records, and official documentation related to an accident.
- This may include the Official Accident Report (OAR), SAPS-related records, ambulance reports, and other relevant personal information where reasonably required.
- Membership commences on the date stated in the membership schedule once the first membership fee has been received and the member has consented to the terms and conditions.
- Hamba Safe may send a digital membership card to the contact number provided by SMS, WhatsApp and/or email.
- A member only qualifies for services once the prescribed data has been received and successful onboarding has been completed.
2. Hamba Safe Services
Hamba Safe provides administrative support, information storage and facility services to members, subject to these terms and conditions.
- In providing the services, Accisure may use the member’s information with consent to obtain legal documents confirming the incident.
- Accisure may place the member in contact with an appropriate medical treatment facility if the member was involved in an accident as a driver or passenger in a motor vehicle and qualifies for medical treatment as described in the RAF Act 56 of 1996.
- Accisure may facilitate admission to the medical facility by providing the necessary information to expedite transfer and admission.
- Admission remains subject to the member agreeing to the terms and conditions of the relevant service providers and facilities.
3. Use of Services
The service may be used if the member was injured as a passenger in a motor vehicle, taxi or bus accident, qualifies for 100% compensation in terms of the RAF Act, and requires medical treatment.
Service Activation
- The member, or a person acting on the member’s behalf, must phone 0860 22 22 42 to inform Hamba Safe of the incident and injuries sustained.
- The caller may be required to provide the membership number or ID number, as well as details regarding the accident, location, time, vehicle registration numbers and the names and ID numbers of injured persons as legally required.
- Accisure may provide reasonable assistance through call centre agents and area representatives to collect the completed Official Accident Report and help assure its accuracy.
Verification and Admission Support
- The information collected may be used by Accisure to verify that the member was involved in a legal road accident that may entitle the member to receive private medical care that will be paid for by the Road Accident Fund.
- The member or person acting on the member’s behalf may need to provide information on the injuries sustained so the nature of the required medical treatment can be assessed.
- Accisure may identify the nearest suitable medical facility, contact that facility, and provide the relevant information required for admission.
- If the first medical facility is unable to accept the member, reasonable steps may be taken to identify the next available facility.
- Once accepted at a medical facility, further treatment will be determined by the applicable service providers until full recovery.
- All medical expenses are claimed by the individual service providers from the RAF.
4. Exclusions of Services
The following exclusions apply to the service:
- If the member was involved in criminal activity at the time of the accident.
- If the member is a foreigner who is illegally in the country, has an expired work permit, an expired visa, or is otherwise unlawfully present at the time of the accident.
- If, as driver, the member has any apportionment or suspected/expected/foreseen liability.
- If, as passenger, the member was the cause of the accident as indicated on the Official Accident Report.
- If the accident occurred outside the borders of South Africa.
5. Services Not Provided by Hamba Safe
Hamba Safe’s role is limited. It is important that members understand what is and is not included.
- Hamba Safe is limited to verifying the incident with the relevant documentation supplied and facilitating transfer and admission to a medical facility.
- Hamba Safe does not, under any circumstances, cover the costs associated with admission to, treatment at, or conveyance to the identified medical facility.
- Hamba Safe is not liable for errors arising from inaccurate or incomplete documentation or reports provided by the member, any person acting on the member’s behalf, or SAPS.
- Admission and further care at the medical facility are provided in terms of a separate agreement between the member and the relevant medical facility.
- Hamba Safe is not associated nor affiliated with such medical facilities and is not responsible for the services provided or not provided at those facilities.
- Hamba Safe is not liable for settling the member’s accounts with any identified medical facility.
6. Third-Party Service Provider
Hamba Safe is brought to members through the third-party service provider Accisure.

7. General Exclusion of Liability
Neither Hamba Safe, nor its directors, employees, representatives, agents and/or shareholders, shall be liable to the member or any third party for any loss, liability, damage, expense or penalty of any nature whatsoever, whether direct or indirect, arising from or attributable to any act or omission pursuant to these terms and the rendering of the services, unless such loss, liability, damage or expense is directly attributable to fraud, dishonesty or gross negligence.
To the maximum extent permitted by law, the maximum liability of Hamba Safe and its directors, employees, representatives, agents and/or shareholders is limited to the value of the membership fees received by Hamba Safe.
Force Majeure
If Hamba Safe is prevented from or delayed in performing any of the services as a result of a Force Majeure Event, it will be excused from performance or punctual performance, as the case may be, for as long as the circumstances continue.
Force Majeure includes circumstances beyond the reasonable control of Hamba Safe, including but not limited to war, invasion, hostilities, civil unrest, state action, sanctions, closure of borders, earthquake, flood, fire, drought, acts of God, strikes, lockouts, industrial action, or interruption of electricity supply.
8. Whole Agreement
These terms and conditions contain all the terms agreed between the member and Hamba Safe in respect of the services, and the member waives the right to rely on any alleged terms not expressly contained in these terms and conditions.
